[Abstract]
The process of commercializing an invention in U.S. follows a circular flow of the following steps: invention, disclosure, assessment, patenting, marketing, monetization, and revenue. This seminar focuses on legal aspects of disclosure and patenting and marketing strategy. In the invention step, an inventor should conduct searches for patentability and freedom-to-operate (FTO). When public disclosure incurs, a patent application must be filed within one year after such public disclosure. When filed, a patent application is examined based on patent eligibility (US law code 101), enabling/written description/definiteness requirements (112), novelty (102), and obviousness (103). Marketing for commercializing an invention may begin before or after the invention is granted for patent. Effective marketing strategies will be discussed.
